A social activist has approached the Bombay high court for protection of the fundamental rights of a 40-year-old mentally challenged woman, whom her family had allegedly deprived of fair share in ancestral properties and had thrown her out of the family residence.
According to the petition filed by Sachin Daftare, the woman has been forced to live in a hut in Nashik, in uninhabitable conditions, after being completely neglected by the family. The petition is slated to come up for hearing before the division bench of Chief Justice Mohit Shah and justice Anoop Mohta on February 13.
Daftare has stated in his petition that after her father, Vitthal Gadekar, passed away in February 1984, his heirs got their names entered on the revenue record as owners of the ancestral property – roughly four acres of agricultural land at Deolali, Nashik.
The petition said the woman’s family members – three brothers and two sisters – did not disclose to the revenue authorities that she was also one of the legal heirs of Gadekar.
Daftare, who works for the betterment of persons with mental disabilities, came across the woman’s case during the course of his social work. He made a detailed representation to revenue authorities in Nashik in November 2011 and sought action to protect the rights of the woman. He approached the high court after the authorities failed to respond to his representation.

{{/usCountry}}The social worker has now sought directions to the Collector of Nashik to hold an inquiry into the matter, take corrective steps and transfer the woman’s share in the ancestral property and house in her name.
