With driver Shyamvar Rai turning into a witness for the prosecution in the Sheena Bora murder case, the defence advocates of the other accused – Sheena’s mother Indrani Mukerjea, Indrani’s husband Peter and Indrani’s ex-husband Sanjeev Khanna – will adopt a wait-and-watch approach.
The special court for the central bureau of investigation (CBI) on Monday granted pardon to Mukerjea’s driver on condition that he would reveal the truth.
While making Rai a prosecution witness, special judge HS Mahajan held the case is based on circumstantial evidence and if one of the conspirators is ready to tell the truth before the court, it should be considered.
Khanna’s advocate Shreyansh Mithare had approached the special court seeking a copy of Rai’s confession statement, but his request was turned down as the court held it was too early to open the statement kept in a sealed envelope. Mithare then moved the Bombay high court. “We will wait for the HC order and a copy of Rai’s confession to decide the next move,” Mithare said.
Peter’s lawyer Mihir Gheewala said they too will wait for the copy of the confession. “With this order, the driver becomes the lone eye-witness to the murder. He is expected to give the details of the crime to the court. However, we will have to see what he has revealed in his statement and his further deposition before the court,” said Gheewala. Indrani’s lawyer Ayaz Khan however said the confession statement is of more importance and is the right of all accused. “We must see what is said in the confession to formulate our further defence,” Khan said.
