3-year-old's rape - Local court acquits mother, uncle after medical report fails to prove sexual assault

The girl, who was admitted to the civil hospital and later shifted to PGI Chandigarh, died on October 11 last year, a month after the incident.

The defence contended that the girl had accidentally fallen from the stairs and sustained injuries.

The case

The girl's mother, a resident of Dassuya, and her brother-in-law were booked by Nakodar Police under sections 376 (F) (rape with a child below 12), 118 (concealing design to commit offence punishable with death or life imprisonment), 201 (causing disappearance of evidence of offence), 202 (intentional omission to give information of offence by person bound to inform) and 34 (committing crime with common intention) of the IPC and sections 6 and 16 of the Protection of Children from Sexual Offences Act on September 11, 2013, on the statement of the girl's father.

The incident

According to the complaint by the father, the crime took place when his wife went to meet her brother-in-law at Guru Teg Bahadur Nagar in Nakodar. He alleged that the accused was living alone after separating from his wife and he allegedly raped the baby at night.

The father alleged that his wife, who was aware of the incident, hid the same but when the girl started showing signs of uneasiness due to serious injuries, she had to be admitted to the civil hospital.The victim's father further said his wife concealed the act to save her brother-in-law.
