Zulfiqar case: Defence seeks documents, photos for framing charges

Charges against Theatre Age director Zulfiqar Khan could not be framed on Friday as the defence counsel filed an application in the court contending that the complete documents, including the original set of photographs of the accused that are part of the challan, have not been provided to them.

The defense counsel has asked for the original copies of the three photographs submitted by Khan’s former partner and whistleblower Kanwarpal, following which the case was registered against the tainted theatre director. Moreover, defence counsel has also asked for the CD that the police had attached with the chalan.

Zulfiqar was provided with the copy of charges to be framed during his previous appearance in the court. The police had handed over the photocopies of the photographs and other documents to the defence counsel to which they had raised objections in the court on Friday.

Defence counsel advocate AS Sukhija said, “We were not given the original copies of the developed photographs. Moreover, the police did not give us the CD that is the part of the chalan and thus, we did not nod to the charges against Zulfiqar.”

Local district court on October 1 had issued notices to the officials of the police station at Sector 36, police post at Sector 43 and officials of the ‘bakshikhana’ at the court premises at Sector 43 to file a reply against the application filed by demanding security at ‘bakshikhana’.

Zulfiqar, who is behind bars since his arrest in July, had allegedly sexually exploited at least five youngsters, including a minor, in the last about 12 years. He was arrested on July 11 for allegedly having unnatural sex with his students on the basis of a complaint of Kanwarpal, a former student-cum-associate of Zulfiqar.

The police on September 8 had filed the challan under Sections 377 (unnatural offences), 292 (sale of obscene books), 506 (punishment for criminal intimidation) of the IPC; and Section 8 and 5 of the Protection of Children from Sexual Offences (POCSO) Act
