A three-judge bench of Justices SK Kaul, Aniruddha Bose and Krishna Murari stuck by its previous ruling that protests were meant to be held in designated places and the police will be within its rights to remove persons holding protest outside designated places.

The Supreme Court ruled on Wednesday that the right to protest and express dissent against governments is a fundamental right, but not absolute and also that public places cannot be occupied indefinitely to stage protests and demonstrations.

While the issue pertaining to Shaheen Bagh itself was rendered infructuous (pointless) since the protests ended after the Covid-19 pandemic broke out and a lockdown was imposed on March 25, the court heard the parties on the larger issue of the right to stage protests in public places and to what extent it can be regulated.
