A surveillance video showing an alleged assault by an Amazon delivery driver at a California gas station has gained attention online after it was shared by attorney Tony Buzbee. The footage is tied to a civil lawsuit filed in Sacramento County on behalf of a 71-year-old agricultural and animal production facilities auditor, who claimed he suffered a concussion and neck injuries in the incident.

According to Buzbee, the incident occurred at an ARCO gas station in Elk Grove, California. Buzbee stated that the old man had stopped during his workday to use the restroom and buy a soft drink when an Amazon delivery driver became upset, believing the older man had taken his parking space.

Buzbee claimed the driver confronted the man in the parking lot before following him inside the convenience store. The driver was later arrested and charged with felony battery, elder abuse and other offences, according to the attorney's social media post.

What does the surveillance footage show?

The surveillance video shared by Buzbee shows a man wearing an Amazon delivery uniform entering the store behind the elderly customer. The driver can be seen making repeated threats and screaming “Imma beat your ass” at the older man while he walks toward the checkout counter.

Moments later, the video shows the driver suddenly striking the 71-year-old from behind. The elderly man falls forward and lands face-first on the floor near the checkout counter.

The cashier is heard gasping after witnessing the violent encounter. However, the footage cannot be independently verified by Hindustan Times. The circumstances leading to the confrontation remain based on allegations contained in the lawsuit and statements made by the plaintiff's attorney.

No public statement has been made by Amazon on the specific claims at the time of reporting.

Lawsuit targets Amazon

The lawsuit argued that Amazon failed to properly screen and train the delivery driver before placing him on delivery routes. Buzbee said the company should be held accountable if its hiring or supervision practices contributed to the alleged assault.

“Amazon delivery folks must be carefully screened and trained,” Buzbee wrote. “Amazon must do better in the hiring process. When Amazon fails, like here, it must be held accountable.”

Buzbee stated that the Amazon driver was taken into custody and accused of elder abuse and felony violence, among other offenses.

According to Buzbee, the civil case has been filed in the Superior Court of California, Sacramento County. He said updates on the litigation will be shared through his social media platforms.
