Coming as a major respite to Sector 50-based resident Ashwani Munjal, the national consumer disputes redressal commission, New Delhi, directed Blood Donors Cooperative House Building First Society Limited to refund the amount of Rs 4.10 lakh charged illegally along with 9% interest from 2002-2008 to him.
National consumer commission issued directives by dismissing the appeal filed by the society against the order of district consumer disputes passed in May 2012, directing the society to refund the amount along with paying `50,000 as compensation and Rs 10,000 as cost of litigation to Munjal.
Munjal had accused the society of illegally deleting his name from the prospective list of allottees, even when he had deposited 25% of the land cost.
He had accused that the society had adjusted the amount paid by him to other non-paying members and sent the list to Chandigarh Housing Board by adding bogus members for extraneous consideration.
The society had directed Munjal to pay Rs 4.10 lakh on account of interest, besides the cost of land and cost of construction in 2008. He alleged that the interest was charged even for the delay caused by the society from February 2008-July 2008. The possession of the flat was not given till October 22, 2008, so he approached the consumer forum, Chandigarh, in June 2010.
The consumer forum in May 2012 had directed the society to refund the amount along with paying compensation and cost of litigation.
The society had filed an appeal which was dismissed. Another appeal filed before the national commission was also dismissed.
