The Punjab government on Wednesday informed the high court that it would comply with the court directions issued on September 21 last year regarding the minimum assured stay of one year of all senior superintendents of police (SSPs), superintendents of police (SPs) and deputy superintendents of police (DSPs).
However, the court was informed that the Punjab governor had signed an ordinance on May 28, saying the maximum stay of police officers could be extended up to five years in public interest.
In his reply, principal secretary, home, DS Bains, said, "Any officer who fails to perform his duties efficiently is liable to be transferred by the government prematurely."
Giving examples, the officer said Gurinder Singh Dhillon, PPS, was transferred in wake of the Faridkot kidnapping case.
However, in case of Mohali SSP Gurpreet Singh Bhullar staying at the same station for over three years, the state counsel said that the state governor had passed an ordinance on May 28, as per which the police officers' tenure is "extendable up to three years, or up to a maximum of five years, if it is in public interest, by giving valid reasons and justifications in the orders".
The development took place during the resumed hearing of a contempt-of-court petition filed by advocate HC Arora, highlighting transfers of police officers before completion of a minimum one-year stay, and in some cases their extended stay.
