Oscar-winning actor Halle Berry has reportedly asked a judge to ban her ex-boyfriend, model Gabriel Aubry, from having any contact with their child. Berry headed to court asking for an emergency custody hearing Tuesday after the former couple's nanny called for a restraining order against Aubry, alleging he shoved her when she arrived to pick three-year-old Nahla from his home, reported TMZ.
Alliance Kamdem told police that Aubry went on a racist rant, screamed and cursed at her, then pushed her.
"I was terrified. The push was so forceful that if there had not been a wall behind me to stop the force of the movement I would have fallen down with Nahla in my arms," Kamdem stated in a sworn declaration.
The nanny made a note that Aubry is nearly a foot taller than her.
Nonetheless, Los Angeles Superior Court Judge Scott Gorden ruled against Kamdem, calling her petition "insufficient and speculative". Aubry is reportedly being investigated by the LA Police Department and Child Protective Services for child endangerment and battery.
Kamdem has now quit as the nanny of the child, and Gabriel's representative has slammed the case.
Berry has been told she will have to wait until Monday to get a decision about the ban on Aubry. The couple has been battling over custody since they split in 2010.
