Arvind Kejriwal arrest Highlights: Delhi CM remanded to CBI custody for three days

In a blow to Delhi Chief Minister Arvind Kejriwal, the Delhi High Court on Tuesday stayed the trial court order granting him bail in the money laundering case arising from the alleged excise scam, holding that the lower court did not "appropriately appreciate" the material placed before it by the Enforcement Directorate.

A vacation bench of Justice Sudhir Kumar Jain said the ED's contentions assailing the bail order required serious consideration.

"The Vacation (trial) Judge while passing the Impugned Order did not appropriately appreciate the material/documents submitted on record and pleas taken by ED and the averments/grounds as raised in the petition under section 439(2) of the Code require serious consideration," it said.

"Accordingly, the present application is allowed and the operation of the Impugned Order is stayed," the court said.

AAP leader Sanjay Singh alleged on Tuesday that the BJP has hatched a conspiracy with CBI officers to frame Delhi Chief Minister Arvind Kejriwal in a "fake case".

There was no immediate reaction to the allegation from the Central Bureau of Investigation (CBI) or the Bharatiya Janata Party (BJP).

In a video message on X, Singh wondered how would one get justice when such things are happening.

"We have learnt from reliable sources that the BJP-led Centre has hatched a conspiracy with CBI officers at a time when there is a huge possibility of Kejriwal getting bail from the Supreme Court. They have planned to frame him in a fake case by the CBI and get him arrested.

Shortly after the CBI examined Kejriwal in Tihar jail, the AAP alleged that the BJP-led union government and the CBI are “conspiring” to register a fake case against the Delhi CM ahead of a court hearing. “At a time when there is a cent per cent possibility that Arvind Kejriwal will get bail from the Supreme Court, sources have informed me that the Centre is conspiring to register a fake CBI case against the Delhi CM and get him arrested by the CBI…The entire nation can see this and is standing in solidarity with Arvind Kejriwal,” AAP Rajya Sabha MP Sanjay Singh said.

According to the Delhi high court, the previous trial court's observation that the voluminous material presented by the ED could not be considered, was “totally unjustified.” “Observation by the trial court that voluminous material cannot be considered is totally unjustified, and it shows that the trial court has not applied its mind to the material,” the court said.

After the Central Bureau of Investigation examined Delhi CM Arvind Kejriwal in Tihar Jail and recorded his statement related to the Excise Policy case, Delhi Bharatiya Janata Party president Virendraa Sachdeva suggested Aam Aadmi Party leaders Saurabh Bharadwaj, Atishi, and Sanjay Singh to question Congress party and said that the case on which the CBI is working, was lodged by the Congress.

The Aam Aadmi Party on Tuesday alleged that the BJP-led Union government and the Central Bureau of Investigation are conspiring to register a fake case against Delhi chief minister Arvind Kejriwal ahead of a court hearing. The Supreme Court will hear Kejriwal’s plea on June 26 against the Delhi high court order putting an interim stay on his bail in the money laundering case.

Delhi Minister Saurabh Bharadwaj on Tuesday said that it is very unusual that without reading the order of the trial court, Delhi High Court stayed the court order granting bail to Delhi Chief Minister Arvind Kejriwal.

Speaking to ANI, the senior Aam Admi Party (AAP) leader said, "It is very unusual that without reading the order of the trial court, Delhi High Court stayed the court order granting bail to Kejriwal...We will make a legal strategy regarding it..."

The Central Bureau of Investigation on Tuesday examined Delhi Chief Minister Arvind Kejriwal in Tihar Jail and recorded his statement related to the Excise Policy case.

Arvind Kejriwal was arrested by the Enforcement Directorate in the Excise Policy money laundering case on March 21, 2024, and is presently in Judicial Custody in the case.

The probe agency on Tuesday also got permission for Arvind Kejriwal's production before the concerned trial court on Wednesday. He will be produced before the concerned court on Wednesday.

According to the CBI sources, he is likely to be officially arrested in the case before the court today.
