Sanjay Raut, Priyanka Chaturvedi on Thursday interpreted the Supreme Court verdict on Sena versus Sena as a tight slap to the Shinde coup as the top court termed the floor test that brought the Shinde government to power- illegal. Uddhav Sena MP Sanjay Raut said Eknath Shinde should now resign on moral grounds as the Supreme Court in its verdict called the Shinde-Fadnavis coup illegal. "Supreme Court has said that the Shiv Sena Shinde group's Whip is illegal...The current govt is illegal and formed against the Constitution," Uddhav Sena MP Sanjay Raut said.

"As per the judgement today, The entire government of Shinde Fadnavis was formed on the basis of an illegal whip deciding who to vote for and a trust vote carried out on the orders of a biased Governor. What a slap on the face of this illegal cabinet," Uddhav Sena MP Priyanka Chaturvedi said.
“The judgment without literally saying it has called the Maharashtra government illegal and unconstitutional! An unconstitutional call by governor for floor test and an illegal whip deciding the CM to be from his illegal faction,” Chaturvedi added.
The Governor of Maharashtra should not allow this unconstitutional and illegal government to function or take any important decisions till the illegal whip’s decision to support change of government is withdrawn and the illegal faction is disqualified by speaker for indulging in immoral acts of betrayal to the state and its political party, the Sena MP added.

{{/usCountry}}The Supreme Court said the floor test order by then governor BS Koshyari was wrong as he erred in concluding that Uddhav Thackeray lost majority. Devendra Fadnavis and other independent MLAs could have moved a no-trust motion, the top court observed. Apart from criticising the role of the governor, the top court said the Speaker was wrong in appointing whip of the Eknath Shinde group. It also said had Uddhav not resigned before the floor test, he could have been reinstated.
'Moral victory for incumbent government'
The Supreme Court said status quo -- the situation before June 2022 -- can not be restored because the top court can't quash Uddhav Thackeray's resignation.
