THE ALLAHABAD High Court has recalled a part of its previous order — by which it had directed the Allahabad University authorities — to hold a fresh election for the post of the president of the AU Students’ Union.
The court said this modification was required in view of the undisputed fact that no election can take place before the expiry of the term of students’ union of the Allahabad University. The term has not expired yet.
Passing this order, Justice SN Srivastava directed the petitioner Raghunath Dwivedi, a student leader of the Allahabad University, to file a fresh representation before the vice-chancellor of the Allahabad University, bringing all the facts to his notice.
The court directed the vice-chancellor to pass an appropriate order expeditiously within a week.
The High Court had on November 22 quashed the election of president of the Allahabad University Students’ Union Ajit Kumar Singh Yadav. Besides, the court had directed the AU authorities to hold a fresh election. The court had also rejected the request of Raghunath Dwivedi, the petitioner, who had secured second place in the election, for declaring him as president.
Instead, the court had asked the AU authorities to hold a fresh election.
Dwivedi, aggrieved over his non-declaration as president, filed the modification application requesting the court to modify its order on November 22 . In the petition, he stated that since the election of Ajit Yadav was declared illegal, the vice-chancellor, who is also patron of the Allahabad University Students’ Union, be directed to take a decision within a specified period on the issue of declaring him as president.
Instead, the court had asked the AU authorities to hold a fresh election.

Counsel for the petitioner said the term of students’ union would expire shortly. Therefore, it would not be possible to hold fresh election. Secondly, he contended that in the similar circumstances, the VCs of certain passed orders in this regard.
