Poll panel orders FIR against Jaya Bachchan

The UP Govt directs the Lucknow police to file an FIR against SP leader Jaya Bachchan for allegedly concealing info about her property in 2006 while filing her nomination.

Samajwadi Party Rajya Sabha MP Jaya Bachchan could face criminal action following directives to lodge an FIR against her for concealing information about two out of three plots of land owned by Amitabh Bachchan in Barabanki in her affidavit filed before the Returning Officer on June 1, 2006.

The Principal Secretary State Assembly and Returning Officer Rajendra Prasad Pandey sent a three-page letter to the SSP Lucknow on Tuesday asking him to lodge an FIR under section 177 of the IPC. The SSP Akhil Kumar said he was seeking legal opinion on the issue.

“Jaya Bachchan should have made a mention about the two properties (Plot number 711 of account number 295 and Plot number 793 of account number 616) of Amitabh Bachchan,” said Pandey while referring to the affidavit filed by her.

“This leads to conclusion that Jaya Bachchan in her affidavit filed on June 1, 2006 has not mentioned correct facts — concealed facts.”

Referring to the Election Commission’s circular (Number 3/ER/2004-JS-II June 2, 2004), Pandey said the concealment of facts in the affidavit invited provisions of Section 125-k read with Section 33-k of the Representation of the People’s Act-1951. “This is a cognizable offence under section 177 of the IPC. Therefore an FIR be lodged against Jaya Bachchan, resident of Prateeksha, North South Road number 10, Juhu Scheme, Juhu Mumbai-400049 and action be taken against her,” said RP Pandey in his letter to the SSP.

Jaya in her statement said the two plots were registered in the name of Amitabh Bachchan in the revenue records only on July 4, 2006 following an order of Nayab Tehildar Fatehpur.

Giving further details of information received from the district magistrate Barabanki about the “Bainama” sale deeds carried out in connection with the land and subsequent disputes, the Returning Officer said Amir Haider in his letter to the EC said that no action could be taken as the cases on the issue were pending in various courts.
