The special CBI court on Monday granted the defence’s request to defer the cross-examination of the first witness in the Sheena Bora murder trial until accused-turned-approver Shyamwar Rai deposes in court.

Lawyers for the accused — Indrani and Peter Mukerjea and Sanjeev Khanna — had pleaded that they would not like to cross-examine the first witness — police officer Ganesha Dalvi, who nabbed Rai with a pistol in Khar — before Rai deposed.
The defence lawyer said it would prejudice his clients’ case if they cross-examined any witnesses before Rai deposed. They said that in case there were nay any contradiction in his deposition, they would have to cross-examine Dalvi.
The prosecution objected to the plea, saying that it would delay the trial and affect its flow. The court, however, refused to accept the objections and granted the defence’s request. The case was adjourned to July 28.
Meanwhile, Peter has sought the case diary of officers of Khar police station who probed the case before it was handed over to CBI. The plea is likely to be heard next week.
