An American national studying at the prestigious Tata Institute of Social Sciences was allegedly raped by a group of six students in April this year.

One of the accused, Kundan Raj Borgohain (23), has moved the Court seeking discharge from the case on the grounds prima facie there is no case against him.

But the Vacation judge S J Kathawala today said the matter needs to be heard at length and adjourned the hearing to January 4.

Court also directed trial court to schedule framing of charges in the case -- where there are total of six accused -- on January 5.

The victim girl was allegedly raped at Borgohain's flat in suburban Andheri. Borgohain was given bail in September, as the High Court felt that prima facie he did not seem to be involved in the rape.
