A Pimpri resident approached the Bombay high court (HC) on Monday, seeking compensation of Rs 25 lakh from a private school in Pune for expelling her 15-year-old son, apparently because his parents were active in an agitation against a fee hike.
A vacation bench of justice SC Gupte and justice AK Menon posted the petition, filed by Vandana Wabale, for hearing on Wednesday.
According to her petition filed through advocate Uday Warunjikar, her son Hritik was studying in Class 9 in a CBSE school in Pimri. The school suddenly asked him to leave on April 23. He had not been allowed to attend his classes since March, after his parents filed a criminal complaint against the school for hiking the fee.
Wabale, who was present in the HC when Warunjikar mentioned the petition for urgent hearing, said she could not get her son admitted to any other CBSE school because of adverse remarks made by the Pimpri institute on the transfer certificate, which cites the reason for his termination as “fee hike.”
The petition alleges the school had detained the boy and subjected him to mental harassment. Wabale has urged the court to interfere in the matter, stating that a child cannot be put at the mercy of unscrupulous educationalists in this manner. She has contended the action of the school amounts to violation of his fundamental right to education, guaranteed under Article 21A.

Apart from the readmission of her son, she has asked for compensation of Rs 25 lakh from the international school, for causing mental trauma to the boy and for disturbing his academic career.
