Omaxe yet to clear land dues for Sector 93B project in Noida, buyers suffer

Residents asked why they should suffer for builders’ fault even after paying the total cost on time.

“I had booked a flat in 2008 and got possession in 2013, after a two-year delay. I paid Rs 85 lakh, the total cost of my 3 BHK flat, to the builder in 2013. The builder also charged Rs 7.25 lakh for stamp duty to execute the registry. Shockingly, the builder refused to execute registry to transfer the title after I paid the total cost,” Chayan Majumdar, a software engineer, resident of Grand Omaxe, said.

Like Majumdar, 300 residents are living in flats since 2012 without legally owning them.

Omaxe started the project that consists 1,320 flats in 22 towers in 2008.

“I shifted in my flat in 2012 after paying the total flat cost. The builder took the money promising me of the registry. But later I came to know from the Noida authority that I cannot legally become the owner of my flat because the builder needs to clear land dues. The Noida authority should come up with a mechanism to do justice to us because we are not at fault,” Rudra Acharya, a doctor with a private hospital and a resident, said.

“This is a big policy fault in the Noida authority’s lease-deed causing troubles to innocent buyers, who cannot own a house even after paying the cost of the flat. The policy needs to be changed so that thousands of buyers do not suffer,” PVS Prakash, a software engineer who is fighting for buyers rights, said.

“We will take strict legal action to address buyers’ issues but we cannot allow registration until the builder clears land dues,” Manmohan Mishra, financial controller of the Noida authority, said.

Vijayalaxmi, chief operating officer of Omaxe said, “I cannot comment on the issue. I will ask the right person to answer questions on the issue.”

Abhishek Anand, a public relations officer with Omaxe, said, “I will ask someone to answer queries on it.” However, the officer did not respond to calls later.

A delegation of the confederation of Delhi-NCR RWAs also met with Pramod Kumar Aggarwal, chief executive officer of the Noida authority, on the issue.

“We demanded that the authority or the UP government come up with a solution to the issues faced by homebuyers. The authority should issue OC to the builders in the ratio of the money deposited by them towards land cost so that buyers do not suffer. The buyers who have paid total cost should be allowed to get their registry executed. We also objected to the sale of extra floor area ratio to builders,” PS Jain, president of CONRWA, said.
