A right to information (RTI) activist, who sought details of appointment process of chief secretary Anthony de Sa, has decided to move high court after the State Information Commission dismissed his application. The complaint was filed with the state general administration department (GAD).
State chief information commissioner (CIC) KD Khan dismissed the complaint on November 12, saying that after hearing the parties concerned (complainant and officials of the GAD), the complaint was not found worth pursuing. The written order of the CIC became available on Monday (copy available with HT).
The complainant Ajay Dubey has said that he would take the matter to high court as the basic RTI norms were not taken into consideration while dismissing the complaint.
In his order, the CIC dismissed the points raised by the complainants that the public information officer had taken six months to decide on his application and the first appellate authority of the department had taken year to dispose the first appeal. Both the application and the first appeal are to be disposed within a month of being filed, according to RTI norms, the complainant said.
The CIC held that the delay was ‘procedural’ and not deliberate. Khan also dismissed the allegation of the complainant Ajay Dubey that the application disposal order was issued on back date.
