Not probing 2G gainers, says MCA

The ministry of corporate affairs (MCA) has clarified that the companies that were awarded spectrum during the period when A Raja was minister for telecommunications are not under its scrutiny for violation of the Companies Act.

The ministry of corporate affairs (MCA) has clarified that the companies that were awarded spectrum during the period when A Raja was minister for telecommunications are not under its scrutiny for violation of the Companies Act.

"This ministry has not taken up the companies mentioned in your letter under reference for scrutiny and hence no violation of the Companies Act has come to the notice of this ministry," the MCA said in a letter to the enforcement directorate.

Since the ministry did not investigate them for violations, this cannot however be construed as a clean chit for the companies in question. The enforcement directorate had sought the information as part of its investigation into possible money laundering in the 2G spectrum case.

"It is requested that any contravention of provisions of companies act/ any other contraventions vis-a-vis report of CAG in the 2G spectrum matter noticed by the corporate affairs by these above mentioned companies may please4 be intimated to this directorate at the earliest for further necessary action," Rajeshwar Singh, assistance director in the directorate of enforcement to the secretary of the ministry of corporate affairs, had written.
