10 year RI for raping a 10 year old girl

The court of Additional District and Sessions Judge Kanchan Mahi sentenced a person to 10-year rigorous imprisonment with a fine of Rs 40,000 for raping and attempting to murder a 10-year-old girl.

The court of Additional District and Sessions Judge Kanchan Mahi on Thursday sentenced a person to 10-year rigorous imprisonment with a fine of Rs 40,000 for raping and attempting to murder a 10-year-old girl.

The victim is a resident of slums of Sector 21.

On a cold winter night of January 2 last year, she was sent to fetch milk from village Mahespur in the night. On the way to milk shop, Belu who was her neighbour asked her whether she wanted to have a toffee.

Thereafter, he lifted her and took her to a vacant place surrounded by bushes, opposite 'Guga Madi' temple, and allegedly raped her. The victim had stated in the court she fell unconscious when she was allegedly hit with a brick many times as she shouted.

The next morning the police found her naked and took her to General Hospital, Sector 6, Panchkula. From there she was referred to PGI, Chandigarh.

Belu was present in the court during her submissions and identified him as the culprit. The age determination test proved that the girl was between 8-10 years and doctor testified in the court that she was raped.

The court sentenced Belu to 10-year rigorous imprisonment with fine of Rs 20,000 under Section 376(2) (f) of IPC (for rape of girl when she is below 12 years) and also for 10-year rigorous imprisonment with fine of Rs 20,000 under Section 307 (for attempt to murder) of IPC. Both the punishments will run concurrently.
