As many as nine out of 12 accused have filed four applications in the Jyoti murder case on Monday for not recording their statements under section 313 of the Code of Criminal Procedure (CrPC), where accused are asked questions about the evidence which has come against them. The court issued notices to prosecution for reply by Tuesday.
Tilak Raj, the person who allegedly drove the truck over the victim to kill her, submitted before the court that no evidence had come against him so far and mobile tower location of his phone had been fabricated in the case.
Paramjit alias Pumma, who was allegedly present along with Doon MLA Ram Kumar Chaudhary at the time of murder, also claimed that no evidence had come against him so far and recording of statement under 313 of the CrPC should be dispensed away with in his case.
In the third application, Kamlajeet, Baljeet, Nirmal and Chaudhary's brother Harbhajan Singh also claimed that no evidence had come against them so far. They are all accused of harbouring the accused when the police were chasing them.
The fourth application has been filed by Ashish, Pankaj Bhandari and Satish, accused of facilitating SIM cards on fake IDs to the accused in the case. They also prayed to be dispensed with recording of their statement as no evidence has come so far against them. They claimed the offence, related with them, occurred in Baddi in Himachal Pradesh so it could not be tried here.
