Nine years after the death of Rajinder Kumar, an employee of Punjab and Haryana high court, in a road accident, city-based Motor Accident Claims Tribunal has held the truck driver responsible for the accident and directed him, the truck owner and the insurance firm to pay `22.13 lakh as compensation along with 7.5% interest to the victim’s kin. The tribunal was presided over by Atul Kasana.
The compensation would be shared by widow Deep Mala, 29, and Maninder Kaur, 60, mother of Rajinder Kumar, who was killed in a road accident on August 2, 2006.
Based on the statement of the eyewitness, the tribunal held truck driver Bachan Singh, hailing from Jammu, responsible for the accident.
The compensation would be paid by Bachan, truck owner Manjit Singh, who hails from Moga, and the truck insurer.
The tribunal said, “The accident took place as the truck was parked in the middle of the road at midnight, without using tailights, thus causing a clear safety hazard for other vehicles due to darkness. It clearly amounts to rash and negligent act on the part of the driver resulting in the accident.”
It may be recalled that on August 2, 2006, at around 2.30 am, Punjab and Haryana high court employee Rajinder Kumar, who worked as restorer, along with two persons were coming from Jalandhar to Chandigarh.When their vehicle reached Sujwalpur near bus stand, it rammed into the truck said to be parked in the middle of the road. Rajinder Kumar died on the spot while others sustained severe injuries.
