Granting a breather to chairman of child welfare committee of Snehalaya, Maloya, additional district and sessions judge Paramjit Singh on Thursday stayed the contempt proceedings.
The official, Neil Robat, on Thursday moved court challenging the contempt proceedings against him for failing to comply with the directives of a court to handover six children living at Snehalaya to their grandfather.
In his petition, Robat said the judicial magistrate did not have the powers to issue directions of handing over possession of the children to their grandfather.
The case would now come up for hearing on September 1.
With the stay, the six children would have to stay at Snehalaya till the petition is decided.
“We would appear before the child welfare committee on Friday seeking custody of the children and would be contesting the appeal filed by Snehalaya,” said advocate Gagan Aggarwal, counsel for Gopali Prashad, grandfather of the six children, who were moved to Snehalaya after their father Jugal Kishore allegedly murdered their mother, Rita, on August 17.
Initiating contempt proceedings on Wednesday, judicial magistrate Shilpi Gupta had issued show-cause notice to Robat for failing to comply with directives of the court to handover the children to their grandfather.
Gopali had moved court seeking custody of the children, which was granted by the court on August 23. Since then he has been visiting Snehalaya to get custody of the children, but has been turned away.
