Developer to pay for not refunding plot’s booking amount

Holding it guilty of deficiency in services, the district consumer disputes redressal forum Chandigarh has directed Ansal Properties and Infrastructure Limited to pay Rs 50,000 as compensation to a New Delhi resident for failing to refund the booking amount.

Holding it guilty of deficiency in services, the district consumer disputes redressal forum Chandigarh has directed Ansal Properties and Infrastructure Limited to pay Rs 50,000 as compensation to a New Delhi resident for failing to refund the booking amount.

Disposing of the complaint filed by Sudhir Khosla, the consumer forum also directed the real estate developer to refund Rs 6.25 lakh paid as advance while applying for a plot along with 7% interest.

The developer would also have to pay Rs 10,000 as cost of litigation.

Khosla claimed that in 2006, he applied for a residential plot in the vicinity of Delhi and paid the real estate developer Rs 6.25 lakh. He alleged that without his consent in June 2011, he was allotted a plot in Golf Links II, Sector 116, SAS Nagar.

Ansal Properties and Infrastructure Limited denying any deficiency in services claimed that Khosla was not a consumer as he had nowhere stated that he had availed of the services for his own use.
