District consumer disputes redressal forum, Chandigarh, has directed the parking contractor at the Elante Mall to refund the cost of car damages to a Sector-15 resident, after the drop gate at the exit dropped, severely damaging the roof of the car, last year.
Besides the repair charges of Rs 16,854, the consumer forum has also directed Tenaga Parking Services (India) Private Limited to pay Rs 15,000 in lieu of the harassment caused and Rs 10,000 as litigation cost to the complainant Jasvir Singh Dhillon, 52.
In August 2013, the supposedly automatic gate at the parking lot inside the mall malfunctioned and refused to open. The parking manager was summoned to the spot, who restarted the machine and signaled Dhillon’s car to cross. However, while passing the gate the iron rod of the drop gate fell on the vehicle, damaging the roof of the car.
Dhillon was assured that the parking lot was insured and they the mall management would get the vehicle repaired from the insurance company. However, in spite of completing all formalities, nothing was done.
Tenaga Parking Services (India) Private Limited rebutted the allegations before the forum and submitted that a technical fault led to the sudden drop of the iron rod . The consumer forum in its July 28, order said: “Negligence and deficiency in service on the part of Tenaga Parking Services (India) Private Limited is writ large from the very fact that it instead of paying the to the complainant, it asked him to approach its insurance company for getting the claim.”
