Emaar MGF told to pay Rs 2 lakh fordelay in giving shop’s possession

The State Consumer Disputes Redressal Commission, Chandigarh, on Friday directed a real estate developer to pay Rs 2 lakh as compensation to a Manimajra resident and his son for delay in handing over possession of their commercial shop.

The State Consumer Disputes Redressal Commission, Chandigarh, on Friday directed a real estate developer to pay Rs 2 lakh as compensation to a Manimajra resident and his son for delay in handing over possession of their commercial shop.

Disposing of the complaint filed by Niripjit Singh Chehal and his father Baljit Singh Chehal, the commission had also directed Emaar MGF Land Limited to refund Rs 44.82 lakh to complainants with 12% interest along with Rs 20,000 as a cost of litigation.

The complainants in order to open a shop had booked a commercial place in Central Plaza at Mohali Hills, Sector 105, SAS Nagar, developed by Emaar MGF. They were assured possession within three years. The deposited amount of Rs 6.55 lakh, however, the proposed layout plan, and also necessary approvals and sanctions, in respect of the project, were not shown to them.

The complainants alleged that the status of construction of the commercial shop was never provided to them and till August 2012 there was no construction at the site.
