Observing that the investigation conducted by Paramraj Singh Umranangal, deputy inspector general (border range), into the corruption cases against former Punjab director general of police Sarabdeep Singh Virk was "not fair and impartial", the Punjab and Haryana high court has, however, dismissed Virk's plea seeking a change of inquiry officer or handing over the inquiry to the Central Bureau of Investigation (CBI).
"The investigation by the present investigating officer is not fair and impartial as he is facing an inquiry of fake encounter, which is pending with the present DGP. The same is in violation of high court directions and an undertaking given before the apex court," said justice Daya Chaudhary.
An FIR under the Prevention of Corruption Act was registered against Virk by the Vigilance Bureau in 2007 and he was charged with indulging in private business by misusing his authority as the head of Punjab Police.
The Punjab government had told the court earlier that investigation into the case was complete and the challan had already been presented before the Mohali trial court, and hence, there was no question of changing the investigation officer at this stage.
Refusing to issue a direction on Virk's petition, the court said the petitioner would be at liberty to avail appropriate remedy, if the necessity so arises, at proper stage(s).
