Disposing of the petition challenging the consolidation proceedings of the Reliance Haryana SEZ Limited, the Punjab and Haryana high court has directed the settlement officer of Jhajjar to decide the appeal seeking quashing of the consolidation process by December 31.
The division bench of justice Surya Kant and justice Shekher Kumar Dhawan disposed of the writ petition filed by residents of Revenue Estate, Badsa, in Jhajjar district.
The petitioners had sought directions to cancel the entries of mutation in the revenue record terming them as “illegal, arbitrary, without jurisdiction and unconstitutional on the ground that land in dispute had become a part of the urban area in 2011”.
While directing the settlement officer, the high court bench, without commenting on the merits of the case, gave liberty to the petitioners to revive the petition in case the order was not served till December 31.
The petitioners having land at Badsa village alleged that the procurement of infertile land in different parts of the district was done, which was later marked as urban land and now consolidation of the land was being done in the prime location.
The petitioners claimed that the land situated in close proximity to the KMP Expressway in the NCR region and touching the boundary of Gurgaon was allotted to India Institute of Medical Science, Phase 2, on lease for 99 years for Rs 48 crore. Reliance had purchased more than 450 acres of the land by way of different sale deeds in 2007.

{{/usCountry}}A writ petition was filed by the petitioners in 2012 in which they had challenged the impugned schemes and impugned entry of revenue record, which was disposed of with directions to provide the remedy. Tehsildar Palwal-cum-consolidation officer passed an order and dismissed their objections on July 15, 2013 “without informing the petitioners”.
Counsel for petitioners Deepak Balyan said, “The petitioners are fighting a legal battle against mighty business houses like Reliance Haryana SEZ Limited and have been running from pillar to post. The petitioners filed an appeal before the consolidation officer which was decided as dismissed for non-prosecution.”
The petitioners appealed before the settlement officer/DRO Jhajjar on October 1 last year, and till date, no decision has been made. Following this, the petitioners approached the high court.
