The Punjab and Haryana high court has ruled that a student who passes his Class 10 examination from a school will not necessarily get admission in Class 11 in the same school if he scores less than the cut-off marks.
The high court bench of justice RK Jain, in its order, has recorded that the schools where seats in Class 11 and 12 are less than the number of students admitted in Class 10, it is not imperative on the part of the school to give admission to all such students who have cleared their Class 10 from the school.
The HC order came on the petition of a city resident who had challenged the decision of St John's High School, Sector 26, of not giving admission to his ward who passed Class 10 examination from the school, but was denied admission in medical stream in the same school earlier this year.
The HC said, "The petitioner is not entitled for an automatic promotion to Class 11 in the same school. Taking for example, after passing Class 10 examination in Chandigarh, the admission in Class 11 is made by way of centralised counselling. The schools are allotted according to the grades/CGPA obtained in Class 10. It is not necessary that a student who has passed his Class 10 from a particular school would get admission in the same school if he obtains less marks than the cut-off percentage in Class 10 of that particular school," the HC bench rued, while dismissing the petition.
The school in this case had argued that seats in Class 9 were less than in the Class 10 and that it had admitted the students on the basis of their academic performance as well as grades scored by student in the co-scholastic areas, especially attitudes and values. The school had produced a circular issued in 2014, wherein the parents of the students were told that re-admission in Class 11 cannot be given to all students because of reduction of four sections of Class 10 into two sections of Class 11 and students can be accommodated on the basis of academic performance as well as in co-scholastic areas.
