CHANDIGARH: The local bodies department, Punjab, has banned registries on the sale of individual floors of multi-storey residential houses developed by the promoters for which the approval was procured for selling the plots or houses as one unit.
An order issued by the senior town planner of the local bodies department on Monday addressed to the additional deputy commissioner (urban development) of the districts where major cities, such as Mohali, Amritsar, Jalandhar, Ludhiana, Patiala, Bathinda etc, fall, said it has come to the notice of the government that certain promoters and developers after obtaining a license to develop a colony gets individual residential building plan sanctioned for either stilt plus three floors or ground plus two floors as per municipal bylaws but sell them on floor-to-floor basis as independent floors.
“We are sending these orders to all districts where promoters are developing group housing facilities,” said senior town planner Gautam Kumar.
His orders apply to all colonies in the state which have taken permissions under the Punjab apartment and property regulation act, 1995 or town planning schemes under the Punjab Municipal Act 1911 or Punjab Municipal Corporation Act 1976 or obtained a regularisation certificate under the provisions of the policy of 2018 for regularisation of unauthorised colonies.
“It is informed that as per municipal building bylaws, independent floors mean residential floors including stilted residential floors on plotted development and planned uniformly in the sanctioned layout plan at the time of approval of a colony or town planning scheme,” adds the communication.

{{/usCountry}}It adds that separate norms have been fixed in the building bylaws for developing independent floors as per which the independent floors are to be considered as per group housing norms and even charges such as external development charges, change of land use, processing fee etc, are to be levied as applicable to group housing projects.
“The practice of selling a dwelling unit on floor-to-floor basis as independent floors by getting individual residential building plans sanctioned for stilt plus three floors or ground plus two floors lead to a non-compoundable violation in the building and it also causes huge financial loss to the urban local bodies,” it further said.
Issuing the ban orders, the local bodies department has asked the district authorities to send details of such projects which have illegally sold as independent floors within seven days and also inform the concerned sub-registrars immediately for not registering sale deeds specifically indicating the name of such projects where unauthorised floors have been constructed.
The orders according to the director of local bodies Uma Shankar pertains to larger projects, which causes a huge loss to the department by circumventing the policy of selling individual floors but have procured permissions and paid charges for selling plots or storeyed houses as one unit.
