HC quashes appointment of MLSU associate prof

HC quashed the seven-year-old appointment of an associate professor of MLSU Udaipur and directed the university to appoint the petitioner in her place within one month with all the notional benefits right from the day of appointment of the respondent.

The petitioner, Anupama Ujjawal had challenged the appointment of Rajshree Choudhary as associate professor on the ground that the respondent had applied for the post in the general category.

While admitting that the petitioner had been discriminated by the university, the court ordered her appointment and also directed the university to provide all notional benefits to her from the date of appointment of the respondent.

The petitioner's counsel Narpat Singh Charan said that one Rajshree Choudhary -- reportedly a relative of former revenue minister Ram Narayan Dudi - had been appointed as associate professor in 2006 under reserved category of other backward class (OBC), even though she had applied under the general category.

The petitioner challenged her appointment before the High Court alleging that the university had discriminated against her and appointed Choudhary, as she was the niece of Dudi.

The court said the action taken by the university was a clear example of favouritism and termed it to be an arbitrary, partial and against the basic principal of justice.
