Family Court disposes of 1,450 pending cases in two-day special drive
Court officials said that the cases which were old and not heard for a long time were segregated and scheduled for hearing during the special drive. They said in the last two to three months, they had prepared a list of cases, which were held up due to absence of one of the two parties. The courts began the process of segregating the cases, issuing notices to the parties to appear before the court.
MUMBAI: A 45-year-old woman from Thane, who has been suffering from Cerebral Palsy, was relieved after the family court at Bandra allowed her plea for divorce, which was pending since July 2019, during the special drive held for two days when the court disposed of around 1,450 pending cases.
The woman from Thane had in June 2001 married a man, who was suffering from a disability. The woman had claimed that nine months after the marriage, her husband had deserted her. After waiting for years, she finally filed for divorce in July 2019, as she wanted to shift to the United States of America for better treatment and life.
Even after filing for divorce, her plea wasn’t heard for long as the woman was not able to serve the notice to her husband as his whereabouts where not known. Finally in April 2022, the court had ordered to hear her plea ex-parte.
Her case was eventually selected for hearing in the special drive and finally after years, she was granted divorce. She would now be able to shift to the US.
In another case, a couple got married on July 29, 2002 and four years after their marriage on May 2, 2006, the husband left from home, never to return. The family had lodged a missing complaint but he was not found. Charkop police in December 2006 closed the case saying the man was not found and untraceable.
The woman had filed a divorce in October 2021 on the ground that no one from their near and dear ones, who knew her husband, had heard about him in the last seven years. Considering the record and police reports, the court granted her plea pending since almost two and a half years.
Principal judge of the family court, Swati A Chauhan and other judges namely Rajkumar Bhakta, Samita Savaskar, Vikram Jagdale, Govind Vayal, Anil laddhah and Kedar Joshi had organised a special drive for the two days on March 28 and March 29.

These cases included petitions for maintenance, divorce, access to children and so on. In one of the petitions, a couple married on April 24, 2002 had separated whereby husband took the custody of the boy and wife took the custody of the daughter.
The wife had in 2018 approached the court to direct her former husband to pay maintenance for their daughter. However, she did not pursue it. During the process, the court issued notice to both the parties. During the drive, the husband appeared before the court and gave a declaration that he would pay ₹5,000 every month to his daughter and he had invested money for her in various insurance policies.
The money, which would be released when the polices mature, would also be given to daughter, assured the man. On the basis of his declaration the petition was disposed of.
