Builders must raze constructions beyond compoundable limits: GDA

The Ghaziabad Development Authority (GDA) officials have asked the enforcement departments to inspect and act against constructions that are beyond compoundable limits

The Ghaziabad Development Authority (GDA) officials have asked the enforcement departments to inspect and act against constructions that are beyond compoundable limits. The move comes in the aftermath of the building collapse in Akash Nagar and the recent demolition drive taken up by the GDA.

Maintaining that constructions beyond compoundable limits need to be demolished by the developers, GDA vice chairperson Ritu Maheshwari, who issued the direction, said, “I have asked the enforcement department to go for inspections and ensure compliance in such cases. There are several constructions, wherein there are deviations to the sanctioned compounding maps. The builders will need to demolish such parts of their construction by themselves.”

According to the law, a builder is obligated to pay a compounding fee if he constructs on the land beyond the sanctioned limit as approved by the authority. Besides paying the fee, the builder also needs to submit the compounding maps, which, once cleared, need to be adhered to. However, constructions over and above 10% of the ground coverage of the sanctioned area map cannot be regularised by paying the compounding fee and need to be demolished. Issues of compounding limits are governed by separate compounding bylaws, framed in 2010.

On July 22, a five-storey under-construction building collapsed, claiming two lives. Since then, the authority, which initiated a demolition drive, has been razing illegal buildings.
