Delhi HC comes to rescue of woman murder convict's children

The Delhi High Court has directed Delhi Legal Services Authority to help a woman murder convict's children, who are seeking transfer of their grandfather's property in their names, and to take the help of National Commission for Women to ensure the duo's protection as they apprehended threat from land grabbers.

Justice S Ravindra Bhat asked DLSA to provide legal assistance to Tanya Sharma, 19 and her 10 year-old brother, seeking transfer of maternal grandfather S S Marwah's property in East of Kailash to their name.

The children sought the court's intervention through a civil suit for the property and alleged that a land grabber has been claiming as the owner of the duplex house.

"The DLSA is directed to get in touch with the plaintiffs (children) and, having regard to their views, approach the suitable executive or statutory agencies to ensure their continued protection and safety. It is open to DLSA to seek assistance of NCW, National or State Commission for Children or any other agency, including the police," the court said.

"The factual element in this case, the material on record and the allegations contained in the FIR provide a startling enough picture to inspire a blockbuster (film) production," the court said.

According to Tanya, her father Sunil Sharma had disappeared leaving behind wife Niti and the children due to poor financial condition in May 2004 and his whereabouts is unknown even today.

Niti, now in police custody, with the help of two others killed her father in May 2006 to grab his properties in a posh area of East of Kailash, said Tanya.

She and her minor brother have been living at the mercy of their neighbours. In February 2009, Judge Chawla had come to them and claimed that he was the owner of their house.

However, with the intervention of the neighbours, the land grabber and his team were prevented from taking possession of their house, she added. Later, she approached this court for justice.
