Consumer Court asks builder to refund Rs 4 lakh

The Gurgaon district consumer forum on Tuesday ordered a city-based real estate developer to refund the full amount to the complainant for not delivering the plot as per the time frame fixed. The complainant is yet to get the plot.

The Gurgaon district consumer forum on Tuesday ordered a city-based real estate developer to refund the full amount to the complainant for not delivering the plot as per the time frame fixed. The complainant is yet to get the plot.

Satish Sharma, the complainant and a resident of Friend's Colony, Gurgaon, filed a case in the district consumer forum claiming that he had paid the developer more than Rs 4 lakh in March 2009 for a developed plot in Kothputli, Rajasthan.

In his petition, Sharma had also alleged that the prescribed site is still not developed and the builder had diverted the money collected from various buyers to some other projects.

Holding the developer guilty of deficiency in service, the bench, comprising consumer forum president RS Bahmani and Mukesh Sharma, ordered the developer to refund the full amount along with 9% interest to the complainant.

Besides, the developer has been ordered to pay Rs 10,000 as compensation and Rs 5,000 as litigation cost to Sharma.
