The Bihar Public Service Commission (BPSC) on Friday withdrew its appeal challenging a Patna high court single bench order, conditionally allowing 35 candidates who have not been issued admit cards, to appear in the preliminary test (PT).
The BPSC had earlier moved the division bench of acting chief justice Hemant Gupta and justice Sudhir Singh against the order passed on Thursday.
After the withdrawal of appeal, the single bench of justice Ravi Ranjan conditionally allowed 10 more aspirants to appear in the 60th to 62nd combined BPSC (PT). Justice Ranjan passed the order on petitions filed by Mayank Kumar and nine others.
On Thursday, while allowing 35 candidates to take the PT, justice Ranjan put a rider, saying that the results would be published only if the candidates were found eligible after the commission had scrutinised their application forms.
The examination, being conducted by the BPSC to appoint 642 government officers, is scheduled for February 12.
Petitioners Nishant Kumar and 34 other aspirants claimed that they had filled up the forms and deposited the requisite fee online. “But it appears that the forms were not uploaded due to some error in the server or slow internet connectivity,” they said. The BPSC had introduced online system for submission of application forms “on a large scale” for the first time without any trial, they claimed.
The BPSC had opposed the petitioners’ claim, saying there was no error in the server. Admit cards were issued to 2.43 lakh aspirants who had successfully filled up the application forms online, the commission said, adding that the petitioners had skipped the final stage of uploading their applications.
