The plea claimed there was no definition in the law regarding internal and external enemy, and the government should clarify its definition as now, “enemy is hiding within the country itself”, which is more dangerous than the enemy across the border.

The plea was filed in the wake of an RTI reply received from the ministry of home affairs stating that there is no information regarding the definition of “soldier”, “sainik”, “fauji” or “jawan”, and also about difference between internal and external enemy.

It sought a direction to the government to clearly specify, which armed force personnel would come under the ambit of ‘soldier’, ‘sainik’, ‘fauji’ or ‘jawan’ in the country.

The petition, filed through advocate Abhishek Kumar Choudhary, also sought a direction to the government to “grant equal financial compensation/benefits to all armed forces personnel on par with other armed forces personnel and uniformed personnel who also come under the definition of ‘soldier’, ‘sainik’, ‘fouji’ or ‘jawan’”.
