The fate of 300-odd unauthorised colonies that are up for regularisation hangs in balance. The Municipal Corporation of Delhi (MCD) has said the notification through which the Delhi Government is planning to regularise these colonies is complicated and, unless amended, residents of these colonies cannot be offered any relief.
“On June 16, 2008, the Delhi Government had issued a notification for providing provisional certificate to the owners. A clause in this notification states that colonies that are part of or are near forestland, riverbed, ridge and ASI land can’t be regularised,” said Vijendra Gupta, chairman of the Standing Committee of the MCD. Gupta added that most part of Sangam Vihar falls in the ridge area and it would not be regularised.
“The Delhi Government is saying that all the 1,432 colonies will be regularised and residents of these colonies will be given provisional regularisation certificates. But what people don’t know is that according to the DDA notification clause, 300 colonies will be left out,” said Gupta.
Calling the Delhi Government’s promise of regularisation a political stunt, Gupta said, “Sainik Farms, Anant Ram Dairy and Mahendru Enclave were not in the ambit of the regularisation process from the beginning. And if one goes by Clause IV of the notification (which says that land near the ridge, riverbed, monuments will not be regularised), then 20 per cent of these colonies will not be regularised. If the government is serious about giving relief, it should think about amending this notification. Otherwise, everything will remain a hogwash,” said Gupta.
Gupta said, according to the notification, the layout plan of unauthorised colonies needs to be approved by a qualified architect. However; there is a shortage of such architects. The residents of unauthorised colonies have once again been asked to file their documents by the Delhi Government. “The documents submitted earlier by the residents welfare associations were handed over to the MCD. We had carried out scrutiny of documents of about 800 unauthorised colonies. Now, the government is demanding documents again. Nearly 40 lakh people living in unauthorised colonies are facing difficulties in collecting documents,” said Gupta.
