The actual trial in Aarushi-Hemraj murder case will begin from June 4.
On Friday, the CBI court charged both the dentists for causing the death of Aarushi and Hemraj.
Over another charge for destruction of evidence with common intention, under section 201/34 of IPC, the court charged the couple with disposing off the second weapon of offence, the blood-stained clothes worn during the crime, cleaning of the scene of crime, cleaning Aarushi’s private parts, covering Hemraj's body with cooler panel, locking the terrace’s door and concealing its keys.
Under the same head, the court also charged them with wiping blood stains from the staircase, hiding and cleaning the golf stick used in the crime, getting wooden partition wall between their and Aarushi's room painted in the same colour and for getting removed the outer iron grill door and iron grill installed next to the door to disturb the scene of the crime.
The lawyers of Rajesh and Nupur Talwar have repeatedly denied these charges and maintained that some Hemraj's acquaintances gained friendly entry and murdered the duo. Talwars’ lawyer VP Rathi said the CBI was relying on circumstantial evidence and there was no 'direct evidence' against them.
In Thursday’s six-page court order, CBI counsels stated the presence of white discharge in Aarushi’s private parts indicated the motive of crime. But the agency is yet to state clearly what the motive of the crime was.
Talwars’ lawyers have further contended that at Aarushi's age, presence of a body fluid on a girl’s body was natural and its presence does not establish that Hemraj was involved in any sexual activity which angered her parents and led to the murders. Even in the closure report, the agency has denied the presence of sperms in the white discharge.
