Admissions to institutions, SC transfers case again

The SC referred the case to a seven-Judge Bench despite two other Benches going into it in detail in the past.

The questions relating to admissions in professional colleges continue to create confusion as the Supreme Court Monday referred them to a seven-Judge Bench despite two other Benches going into it in detail in the past.

A Bench comprising Chief Justice RC Lahoti and Justice GP Mathur referred a bunch of petitions filed by several institutions, private and religious, seeking clarification in regard to a host of issues relating to admissions into professional colleges.

An 11-judge Bench in TMA Pai Foundation case had given several landmark rulings pertaining to admissions into professional colleges and the right of the minority educational institutions to run and administer the institutions established by them.

When several doubts were raised on the judgment rendered by the 11-judge Bench was raised, a five-judge Bench had attempted to clarify them.

But, this year several petitions were filed seeking clarifications pertaining to the fixing of management quota in private unaided professional colleges vis-à-vis the quota for meritorious students. Many of these colleges have also sought a ruling on the quota for NRI students.
