Attack on PDP worker: Accused gets bail

A JAMMU and Kashmir court today granted bail to the person accused of murderous attack on Peoples? Democratic Party (PDP) worker and disrupting the Prime Minister?s rally taken out in Kashmir on November 17.

A JAMMU and Kashmir court today granted bail to the person accused of murderous attack on Peoples’ Democratic Party (PDP) worker and disrupting the Prime Minister’s rally taken out in Kashmir on November 17.

While granting bail to Reyaz Ahmad Gojree, a resident of Ludhoo, Pampore, Judicial Magistrate First Class (JMIC) Amarjeet Singh Langeh observed, “There is no motive attributed to the accused/applicant as to why he could have disturbed and disrupted a political rally. The alleged offences can at the most tantamount to causing hurt or grievous hurt but not the one, which could be brought within the ambit of Section 307 of the RPC. There, thus appear to be a reasonable ground for believing that prima facie offence under Section 307 of the RPC cannot be said to have been made out against applicant in the facts and circumstances of the case as of now.”

The Judge granted bail to the accused on personal bond of Rs 10,000. Judge Amarjeet Singh Langeh also directed the accused to not intimidate the prosecution witnesses and not to tamper with the prosecution evidence.

While granting bail, the Judge held, “It is trite position of law that threadbare examination of prosecution case cannot be undertaken at the time of considering a bail application. It is equally true that bail order ought to be a reasoned one. Keeping this golden principle as a guideline and without resorting to exhaustive exploration, I propose to deal with this application.”
