Moving the application before Special Judge VK Singh, defence counsel Mridul Rakesh argued that the CBI was an investigating agency and could not prosecute in the matter.

The job of the CBI was to investigate and not prosecute, he contended and pleaded that the present case should be the State vs Advani and the others.

He said the Uttar Pradesh state government could launch the prosecution.

The court fixed April 29 for hearing the CBI counsel's arguments.
