Sohrabuddin was killed in an alleged fake encounter by a joint team of policemen from Gujarat and Rajasthan on November 26, 2005 and his wife was murdered two days later.

Justice Akil Kureshi passed his order on an appeal by the CBI against a lower court order on Wednesday denying it Shah's custody.

The High Court has also ruled out video recording of Shah's questioning during the police remand as demanded by Shah's lawyer Ram Jethmalani but it has allowed him to be present "at visible distance and not at audible distance" during questioning.

Appearing for the prosecuting agency CBI, senior advocate K T S Tulsi submitted the lower court had committed an error in holding that its plea for custody could not be entertained as the agency had questioned Shah for only three hours over three days.
