?Coaching centres can?t forfeit fees?

The State Consumer Commission has held that educational/coaching institutions cannot be allowed to forfeit fees received in advance in case students have not availed of the services.

Terming the rule ‘fees once paid will not be refunded’ as ‘unjust’, the State Consumer Commission has held that educational/coaching institutions cannot be allowed to forfeit fees received in advance in case students have not availed of the services.

"No service provider like the training institutes, educational institutes/schools or the coaching centres can be allowed to forfeit the fees,” said Justice J D Kapoor, president of the Commission.

Dismissing the appeal of Brilliant Tutorials, a reputed coaching centre for IIT and medical entrance tests, the Commission said that enforcing such terms, which empowered it not to refund the fees to students, amounted to "unfair trade practices."
