According to prosecution, Tomar was going to Agra from Mumbai, when some boys boarded the train from Bhopal. They were going to Vidisha and one of them sat on Tomar’s berth. When Tomar saw him sitting on his berth, he caught hold of him by his collar and started beating him. Other friends of the boy intervened and a scuffle ensued.

The matter seemed to have been settled when Tomar took out his revolver and fired four times. Three bullets hit one of the boys Pradeep, who died in the hospital four days later, while Virendra Kumar, hit by the fourth bullet, was saved.

The matter was reported at GRP police station Bhopal and following investigation, a charge sheet was presented in the court in 1991. But, during trial Tomar went absconding.
