Court issues notice to doctors

In an interesting case filed at the District Consumer Forum (DCF) Kanpur city by two senior citizens (husband and wife), the DCF has issued notice to two senior doctors of the JK Cancer Institute Kanpur for giving wrong treatment to Kamla Awasthi (66). Court fixed the next hearing date on March 17, 2007.

In an interesting case filed at the District Consumer Forum (DCF) Kanpur city by two senior citizens (husband and wife), the DCF has issued notice to two senior doctors of the JK Cancer Institute Kanpur for giving wrong treatment to Kamla Awasthi (66). Court fixed the next hearing date on March 17, 2007.

According to defence counsel Shailesh Kumar Trivedi, Kamla Awasthi wife of Ramdutt Awasthi, resident of the Kidwai Nagar noticed a gland in her right armpit. Kamla along with her husband contacted to Dr TVS Jaiswal for the treatment at his residence and paid Rs 300 as consultancy fee.

According to petitioner, Jaiswal told her that she had developed cancer and she required further medical checkup on the following day at JK Cancer Hospital.

After conducting some pathological test at the hospital, Dr Jaiswal advised him to follow the cancer treatment. The treatment started from March 30,1998 and continued till March 22,1999.

The petitioner stated that during the yearlong treatment, she was administered nine injection costing worth Rs 1,000.

However, they said that numbers of other injections were also given each time and total expenditure was about Rs 6,000 each time, she visited the hospital.

Petitioner pleaded that she did not observe any relief and informed the doctors about the same, but no satisfactory answers were received from them.

Interestingly, in between the treatment the petitioner also contacted to Dr Ishwar Chandra Khare on May 24,1998, who also conducted relevant tests and informed the petitioner that she was suffering from cancer.

About the treatment, Dr Khare informed that about five to six injections were required for the patient and she would get relief.

Following the instructions of Dr Khare, petitioner was administered the prescribed injections by Dr Khare, but she felt no relief. However, after taking the injections, she felt some side effects.

Meanwhile, she informed the doctors about side effects. But doctor did not pay attention to her problem.

Therefore, petitioner decided to approach to some other doctor for her treatment and visited Sanjay Gandhi Post Graduate Institute, Lucknow for further treatment and after paying Rs 2,000 she got her registration number 20002381000 dated on September 11, 2001.

After carrying out primary investigation, doctors at the PGI diagnosed that she was suffering from TB. At PGI, she was given treatment for TB from September 27, 20001 to September 27, 20002.

In the petition, they alleged that during the treatment at JK Cancer Institute they spent about Rs 2 lakh and suffered mental and physical torture too. They filed a case before the DCF and demanded Rs 3 lakh from the doctors.

According to DCF sources and counsel of the petitioner, the petition was accepted and both the doctors were issued the notices and next date of hearing was fixed on March 7, 2007.

Talking to Hindustan Times, Dr Ishwar Chandra Khare said, “I don’t remember any such patient by name but we don’t prescribe any treatment without proper medical investigations.”

Doctor Khare said, “Till now I have not received any notice from the court.”
