Vexed that the CBI had, without any apparent explanation, dropped four of the 12 accused named in its FIR against Kolkata-based company Vini Iron and Steel Ltd (VISL), a special court on Friday returned the agency’s chargesheet in the case.
Noting that “only one director (of VISL) has been arrayed as an accused,” special judge Bharat Parashar said that the CBI had given no “legally admissible logic or reasoning” in its final report as to why the remaining four accused had not been chargesheeted.
CBI also failed to take sanctions to prosecute public officials Basant Kumar Bhatacharya and Bipin Bihari Singh. CBI booked Vini Iron and Steel Udyog Ltd, its seven directors including CEO Vaibhav Tulsyan, and unknown government officials under conspiracy, cheating and corruption.
The court has asked the CBI to obtain the necessary sanctions before re-filing the chargesheet.
The case involves coal blocks allocations to Vini Iron and Steel Udyog Ltd in Rajhara in which its directors and unknown ministry of coal officials, the Jharkhand government and others were made accused in the September 2012 FIR lodged by the CBI.
This is the third time since it began hearing the controversial coal scam cases that the court has discomfited the CBI by asking difficult questions related to its investigation. Earlier, it had asked the agency’s officers handling the scam investigations to read the August 25 SC judgment which declared illegal coal blocks allocated from 1993 to 2010. It has asked for clarifications on closure reports, including those pertaining to cases against Navbharat Power Pvt Ltd and Kamal Sponge Steel & Power Ltd.
