Noting that Election Commission report on the raid in the party's Keshpur office in West Bengal was not borne out by facts, CPI(M) on Sunday charged the Commission with adopting a "partisan behaviour" and sought an explanation as to whether poll observers had executive authorities under the present laws.
"The CPI (M) regrets that the Commission has come to the conclusion which are not borne out by facts of the enquiry," party's polit bureau said in a statement.
Commenting on the Commission's report that "distorted and unfounded allegations have been made against the observer who performed his duty correctly and in right earnest", the CPI (M) said this "seems more of a post facto defence for partisan behaviour."
The party alleged that some of the observers were "arrogating executive powers to themselves" considering the way "they were behaving in ordering arrests and raids".
"It is necessary for the EC to clarify whether the Observers have executive powers under the present laws of the land to direct such raids," it said.
CPI (M) said all political parties must be concerned by the attitude adopted by the Commission which "does not consider raids on offices of a nationally recognised party, instigated by electoral rivalry of an opposing candidate, to be a serious matter".
