In a statement filed before the High Court, the Commission stated that this proposal was put forward by the Commission in 2004 as part of electoral reforms.

The Commission further submitted that a writ petition challenging the validity of exit polls was pending consideration before the Supreme Court and the Commission would be bound by the decision of the Apex Court.

The EC made its submissions on a PIL filed by a UDF worker, Shameemm Poovath of Mattancherry, seeking to prohibit the media from announcing exit poll results before completing polling in all the constituencies.
