HEARING A case relating to forged court orders, the Allahabad High Court took serious view of the absence of senior superintendent of police in the meeting of the committee appointed by the court to monitor investigation in the case.
“The SSP’s plea that he was not aware of the order of this court is unbecoming of him,” the court said.
Earlier, the court had directed the SSP to appear before the court to explain as to why the investigating officer in the case was transferred from this district to another during the course of investigation even though the court had at one stage directed not to transfer him.
Putting up this case for further orders, Justice Amar Saran directed the SSP to take greater interest in the matter and to attend the meetings of the committee, appointed by this court of which he is also a member, so that he might be able to render effective assistance to this court and not to take the plea as he has taken in counter affidavit that he was not aware of the order of this court.
However, while dropping the proceeding against the SSP, Allahabad and DGP, Lucknow, the court observed, “More seriousness should be given to these matters relating to forged orders and the officers who are performing doing an efficient job, should not be lightly transferred as such orders demoralise the officers and erode the confidence of people in the investigation machinery. It also creates an apprehension in the mind of the court as to whether the State is seriously interested in tackling the issue of forged orders and in bringing the offenders to book”.

{{/usCountry}}As per the direction of the court, SSP Vijay Singh Meena appeared before the court and filed his affidavit. The affidavit of director general of police, Bua Singh was also filed.
On behalf of the State, Advocate-General SMA Kazmi submitted that Circle Officer Rajeshwar Singh, who was investigating this case, had not been transferred from the investigation of this case of forged court’s order. It was further assured by the Advocate-General that all facilities would be provided to Rajeshwar Singh whenever he needed to come to Allahabad for the purpose of investigation of this case or for appearance before the committee or High Court. He also submitted that head constable, Ram Raj Singh, whose transfer this court had restrained by the order dated August 25, shall not be transferred without prior permission of this court. In view of these submissions, this court dropped the proceeding against SSP Allahabad and DGP, Lucknow, for violating its earlier order.
The court had called SSP to appear before the court to explain as to why CO Rajeshwar Singh was transferred in spite of High Court’s previous direction not to transfer him during investigation of the case.
Elaborating its stand, the court said, “In spite of monitoring of all the cases of forged orders, except the successes shown by CO Rajeshwar singh and head constable Ram Raj Singh, there have been no further successes in the investigation by the CB-CID.
